Terms of Use

These Terms of Use (“Terms”) govern access to and use of Hecttor, a product of Saima Inc., a Delaware corporation (“Saima,” “Company,” “we,” “us,” or “our”).

Hecttor includes our websites, desktop applications, software development kits, APIs, integrations, documentation, software, and related services, including the Hecttor Desktop App, Hecttor Hermes SDK, Hecttor Orpheus SDK, VCore, and any other products or services made available by Saima (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.

If you access or use the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms. In that case, “Customer,” “you,” and “your” refer to that organization.

We may update these Terms from time to time as Hecttor evolves. If we make material changes, we will provide notice through the website or via email. Continued use of Hecttor after such updates constitutes acceptance of the revised Terms.

1. Acceptance of the Terms of Use

These Terms apply unless you have entered into a separate written agreement with Saima, such as an order form, pilot agreement, master services agreement, SDK license agreement, reseller agreement, or other signed commercial agreement.

Users authorized by the Customer to access Hecttor, including employees, contractors, agents, and representatives, are referred to as “Authorized Users.”

If there is a conflict between these Terms and a separate written agreement signed by both parties, the separate written agreement will control the extent of the conflict.

Purchase orders or similar documents issued by Customer are for administrative convenience only and do not modify these Terms unless expressly agreed in writing by Saima.

By accessing or using Hecttor, you:

  • Confirm that you have read and understand these Terms and the Privacy Policy
  • Represent that you have authority to bind your organization
  • Agree to be legally bound by these Terms

If you do not agree, you must not access or use Hecttor.

2. Definitions

Authorized Users means employees, contractors, agents, or representatives authorized by Customer to access or use the Services.

Customer Application means any product, platform, system, application, or service owned or operated by Customer into which the Services, SDKs, or APIs are integrated.

Customer Data means data, content, or information provided by or on behalf of Customer or its Authorized Users in connection with use of the Services.

Documentation means technical, product, security, integration, API, SDK, user, and administrative documentation made available by Saima.

End Usersmeans individuals who interact with Customer's products, platforms, services, or communications systems where the Services may be used.

Operational Data means technical, diagnostic, configuration, usage, performance, license, and service-related data generated through operation of the Services, excluding call audio, conversation content, transcripts, or biometric voiceprints.

Order Form means an ordering document, subscription form, statement of work, online checkout, or other written agreement specifying commercial terms.

Servicesmeans Hecttor's websites, desktop applications, SDKs, APIs, integrations, documentation, software, tools, and related services.

Software means Hecttor software, including desktop applications, SDKs, APIs, drivers, models, libraries, updates, and related components.

3. The Services

Hecttor provides real-time voice and speech processing technology, including voice clarity, noise cancellation, voice enhancement, speech speed adjustment, voice isolation, turn-taking, voice activity detection, and related audio processing capabilities.

Depending on the product and deployment model, Hecttor may be used as:

  • Hecttor Desktop App: software installed on agent or user devices for real-time human-to-human voice clarity.
  • Hecttor Hermes SDK: an SDK for embedding real-time human-to-human voice clarity into communication platforms.
  • Hecttor Orpheus SDK / VCore: an SDK or processing component for preparing speech for ASR, analytics, Voice AI, and machine-driven systems.
  • Other Services: additional tools, integrations, APIs, documentation, or related services made available by Saima.

4. Eligibility and Authority

You may use the Services only if you can form a legally binding agreement and are not barred from using the Services under applicable law.

If you use the Services on behalf of an organization, you represent and warrant that:

  • you have authority to bind that organization;
  • the organization agrees to these Terms;
  • all Authorized Users will comply with these Terms;
  • you are responsible for all activity under your account and by your Authorized Users.

5. Account Registration and Security

To access certain Services, you may need an account, login credentials, license key, admin account, or other authentication method.

You agree to:

  • provide accurate account and business information;
  • keep login credentials confidential;
  • prevent unauthorized access to the Services;
  • promptly notify Saima of suspected unauthorized access or security incidents;
  • ensure Authorized Users comply with these Terms;
  • maintain reasonable security controls for account access.

Saima may suspend or disable access if we reasonably believe there is unauthorized activity, a security risk, breach of these Terms, or a legal requirement to do so.

6. License Grant

Subject to these Terms and any applicable Order Form, Saima grants Customer a limited, non-exclusive, non-transferable, non-sublicensable license to:

  • access and use the Services for internal business purposes;
  • install and run the Hecttor Desktop App where licensed;
  • integrate and use the applicable SDKs or APIs within authorized Customer Applications;
  • permit Authorized Users to use the Services in accordance with these Terms.

The Services are licensed, not sold. Saima reserves all rights not expressly granted.

You may allow Authorized Users to access Hecttor under your account, provided they comply with these Terms.

7. License Restrictions

To protect Saima's intellectual property and ensure the security and integrity of our Services, you shall not:

  • Copy Hecttor or any component thereof, except as expressly permitted by this license or as necessary for backup purposes consistent with industry standard practices;
  • Modify, translate, adapt, or otherwise create derivative works or improvements, whether or not patentable, of Hecttor or any component thereof;
  • Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of Hecttor or any part thereof, except to the extent such restriction is prohibited by applicable law;
  • Remove, delete, alter, or obscure any trademarks, or any copyright, trademark, patent, or other intellectual property or proprietary rights notices from Hecttor, including any copy thereof;
  • Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available Hecttor, or any content, features, or functionality of Hecttor, to any third party for any reason, including by making Hecttor available on a network where it is capable of being accessed by more than one Device at any time, except as expressly authorized in your subscription agreement;
  • Remove, disable, circumvent, or otherwise create or implement any workaround to any copy protection, rights management, or security features in or protecting Hecttor;
  • Use Hecttor to develop, test, or market any competing product or service;
  • Use Hecttor in any manner that could damage, disable, overburden, or impair Hecttor's infrastructure or interfere with any other party's use of Hecttor;
  • Attempt to gain unauthorized access to any systems, accounts, or networks connected to Hecttor through hacking, password mining, or any other means;
  • Use any automated means (including bots, scrapers, or spiders) to access Hecttor for any purpose without our prior written consent;
  • Use Hecttor in violation of any applicable local, state, national, or international law or regulation.

Enforcement: Violation of any of these restrictions may result in immediate termination of your license and access to Hecttor, and may subject you to civil and criminal liability.

8. SDK, API, and Integration Terms

If you use any Hecttor SDK, API, or integration component, you are responsible for your Customer Application and all end-user interactions.

You may not:

  • expose SDK functionality as a standalone service unless expressly authorized;
  • resell, sublicense, or distribute SDK functionality except as permitted in an Order Form or written agreement;
  • use the SDK outside the licensed product, territory, environment, or use case;
  • misrepresent Hecttor's capabilities, performance, security, or privacy architecture;
  • remove required attribution, notices, or license controls;
  • use SDK outputs to reverse engineer Saima technology;
  • exceed applicable usage limits, concurrency limits, or licensed deployment scope.

You are responsible for:

  • providing appropriate disclosures to End Users;
  • obtaining required consent;
  • complying with privacy, telecom, call recording, workplace monitoring, and data protection laws;
  • maintaining your own end-user terms and privacy policies;
  • ensuring your Customer Application does not use the Services unlawfully.

9. Trials, Pilots, and Beta Features

Saima may make trials, pilots, evaluation versions, beta features, preview features, or experimental functionality available.

Unless otherwise agreed in writing:

  • trial, pilot, and beta access is for evaluation only;
  • such access may be limited, modified, or discontinued at any time;
  • beta features may be incomplete, unstable, or subject to change;
  • no uptime, support, performance, or service-level commitments apply;
  • you may not use evaluation access for production or commercial deployment without written authorization.

10. Prohibited Use Cases

You may not use Services to:

  • perform biometric identification, voice recognition, or voiceprint profiling;
  • enable unlawful surveillance, monitoring, or interception of communications;
  • process data without appropriate legal basis or required consent;
  • violate telecommunications, privacy, employment, data protection, healthcare, financial, emergency communications, or other applicable laws;
  • make automated decisions where prohibited by law or without required human oversight;
  • create or support unsafe, deceptive, discriminatory, or unlawful systems;
  • use the Services in high-risk environments where failure could cause death, personal injury, or severe physical or environmental harm, unless expressly authorized in writing.

Customer is solely responsible for determining whether its use of the Services is lawful and appropriate in its jurisdiction and use case.

11. Customer Responsibilities

Customer is responsible for:

  • all activity by Authorized Users;
  • account administration and access controls;
  • configuration of the Services;
  • the legality of Customer's use case;
  • the content, operation, and compliance of Customer Applications;
  • obtaining required consents and notices from End Users;
  • compliance with third-party platform terms;
  • maintaining appropriate security, backup, and business continuity practices.

Hecttor is a technical tool. Customers remain responsible for all operational, business, legal, safety, medical, emergency, compliance, and human judgment decisions.

12. Data Processing and Privacy

Hecttor is designed with a privacy-first architecture. Unless otherwise expressly agreed in writing, Hecttor is designed so that call audio is processed locally or within Customer-controlled environments and is not transmitted to Saima systems for processing.

12.1. Information That May Be Collected

Saima may collect limited information necessary to operate and improve the Services, including:

  • account and subscription information;
  • business contact information;
  • Authorized User information, such as business email and role;
  • license verification data;
  • technical diagnostics;
  • configuration data;
  • product usage data;
  • system performance data;
  • billing and support information.

This data does not include conversation content.

12.2. Purpose of Use

This information is used to:

  • provide, maintain, and secure the Services;
  • authenticate users and verify licenses;
  • provide support and troubleshooting;
  • monitor performance and reliability;
  • manage subscriptions and billing;
  • improve product functionality;
  • comply with legal obligations;
  • enforce these Terms.

12.3. What Hecttor Does Not Collect

Unless expressly agreed in writing, Saima does not collect or store:

  • call audio or voice recordings;
  • conversation content or transcripts;
  • personal data contained within conversations;
  • biometric voiceprints or identification data.

Audio processed by Hecttor does not leave your infrastructure.

12.4. Data Roles

Saima acts as a controller for business contact, account, billing, website, and administrative data.

Saima acts as a processor only where it processes personal data on behalf of the Customer under an applicable data processing agreement or written agreement.

Customers remain responsible for End User notices, consent, legal basis, call recording compliance, workplace monitoring compliance, and other applicable legal obligations.

13. Privacy Policy

All collection, use, retention, sharing, and protection of personal information is further described in Saima's Privacy Policy, which is incorporated into these Terms.

14. Aggregated and De-Identified Data

Saima may use aggregated or de-identified Operational Data to operate, secure, analyze, and improve the Services, provided such data does not identify Customer, Authorized Users, End Users, or conversation content.

Saima will not use Customer call audio, conversation content, transcripts, or biometric voiceprints for training or improvement unless expressly agreed in writing.

15. Updates

Saima may, from time to time, in our sole discretion, develop and provide updates to Hecttor and/or make changes to all or parts of Hecttor and/or the Site, which may include:

  • Upgrades and enhancements;
  • Bug fixes and patches;
  • Error corrections;
  • New features and functionality;
  • Modifications or removal of existing features;
  • Security updates.

Saima will use reasonable efforts to avoid materially reducing core functionality during an active paid subscription, except where changes are required for security, legal, technical, or operational reasons.

16. Third-Party Integrations

The Services may integrate with or operate alongside third-party systems, including contact center platforms, telephony systems, CRM tools, UCaaS, CCaaS, VoIP systems, browsers, operating systems, and cloud services.

Saima is not responsible for:

  • Third-party performance or availability
  • Changes affecting integrations
  • Third-party data practices

Customers are responsible for:

  • Third-party compliance
  • Configuration and access management

16.1. Third-Party Responsibility

Saima is not responsible for:

  • the availability, functionality, or security of third-party platforms;
  • any changes to third-party platforms that may affect Hecttor integration;
  • third-party data processing practices or privacy policies;
  • costs associated with third-party platforms.

16.2. Customer Responsibility

As a Customer, you are responsible for:

  • obtaining necessary licenses and authorizations for third-party platforms;
  • configuring integrations according to your business requirements;
  • ensuring compliance with third-party terms of service;
  • managing access credentials and security for integrated platforms.

17. Fees, Payment, and Subscriptions

Fees, payment terms, subscription periods, usage limits, and billing models are set out in the applicable Order Form or written agreement.

Unless otherwise agreed in writing:

  • fees are due as stated in the applicable Order Form;
  • fees are non-refundable;
  • Customer is responsible for applicable taxes, duties, levies, and similar charges, excluding taxes based on Saima's income;
  • subscriptions renew automatically unless cancelled in accordance with the applicable agreement;
  • usage-based fees, overages, or minimum commitments may apply where specified;
  • late payments may result in suspension or termination of access.

Unused credits, minutes, seats, or usage allowances roll over only if expressly stated in the applicable Order Form or written agreement.

18. Support and Service Levels

Support, maintenance, uptime commitments, service-level commitments, response times, dedicated support, or deployment assistance apply only if expressly stated in an applicable Order Form, support agreement, or written agreement.

Unless expressly agreed, Saima does not guarantee uninterrupted or error-free availability of the Services.

19. Intellectual Property Rights

19.1. Ownership

Hecttor, including all software, features, functionality, and content, is owned by Saima, its licensors, or providers and is protected by applicable intellectual property laws. This includes:

  • software, algorithms, and models;
  • design, interfaces, and architecture;
  • documentation and technical materials;
  • trademarks, logos, and branding.

19.2. No Transfer of Ownership

You do not acquire any ownership rights in Hecttor. All rights not expressly granted are reserved.

19.3. Restrictions

You may not:

  • copy or distribute Hecttor beyond permitted use;
  • extract or attempt to access proprietary technology;
  • remove or alter intellectual property notices.

19.4. Consequences of Breach

Violation of this section may result in:

  • termination of access;
  • legal action for infringement.

20. Customer Data

As between the parties, Customer retains ownership of Customer Data.

Customer grants Saima a limited right to use Customer Data only as necessary to provide, secure, support, and operate the Services, comply with law, and enforce these Terms.

Saima does not claim ownership of Customer call audio, conversation content, or End User communications.

21. Feedback

If Customer, Authorized Users, or End Users provide feedback, ideas, suggestions, comments, improvements, or recommendations regarding the Services, Saima may use such feedback without restriction or obligation, provided Saima does not disclose Customer Confidential Information.

22. Confidentiality

“Confidential Information” means non-public business, technical, product, financial, security, pricing, roadmap, integration, or operational information disclosed by one party to the other that should reasonably be understood to be confidential.

Each party agrees to:

  • protect the other party's Confidential Information using reasonable care;
  • use Confidential Information only for purposes of these Terms or the applicable agreement;
  • not disclose Confidential Information except to employees, contractors, advisors, or service providers who need to know and are bound by confidentiality obligations.

Confidential Information does not include information that is publicly available, independently developed, lawfully received from a third party, or already known without restriction.

A party may disclose Confidential Information where required by law, provided it gives reasonable notice where legally permitted.

23. Trademarks

23.1. Hecttor's Trademarks

The following are trademarks of Saima, or its affiliates or licensors:

  • The Hecttor name and wordmarks;
  • The Hecttor logo and application icons;
  • “When Comprehension Flows Both Ways” and related slogans;
  • All related names, logos, product and service names, designs, and slogans associated with Hecttor.

23.2. Restrictions

You must not use any of the foregoing marks without the prior written permission of Saima. Unauthorized use of Saima's trademarks may violate trademark laws and constitute trademark infringement.

23.3. Third-Party Marks

All other names, logos, product and service names, designs, and slogans displayed on Hecttor are the trademarks of their respective owners. Nothing in these Terms grants you any right to use such third-party trademarks.

23.4. Trademark Guidelines

If you are granted permission to use Saima's trademarks (for example, as an integration partner), you must comply with our trademark usage guidelines.

23.5. General Information Purposes

The information presented on or through Hecttor and/or the Site is made available solely for general information purposes regarding Hecttor's Services, features, and capabilities.

We do not warrant or guarantee the:

  • accuracy of information presented;
  • completeness of any materials or documentation;
  • usefulness for any particular purpose;
  • currency of information (except where specifically dated);
  • reliability of any third-party information included in our materials.

23.6. Your Risk

Any reliance you place on information obtained from Hecttor or the Site is strictly at your own risk. You should:

  • independently verify any information critical to your business;
  • consult with qualified professionals before making business decisions based on information from Hecttor;
  • test and validate the Services' functionality in your specific environment before full deployment.

23.7. Disclaimer of Liability

We disclaim all liability and responsibility arising from any reliance placed on such materials by:

  • You
  • Any other user of Hecttor and/or the Site
  • Anyone who may be informed of any of its contents

23.8. Not Professional Advice

Information on Hecttor and the Site does not constitute:

  • Legal, financial, or tax advice
  • Technical specifications or warranties
  • Professional consulting or recommendations
  • Guaranteed performance metrics or results

For professional advice specific to your situation, consult appropriate qualified advisors.

24. Publicity

Unless otherwise agreed in writing, Customer may not publicly use Saima's name, Hecttor's name, logos, trademarks, or product references in marketing, press releases, case studies, or public announcements without Saima's prior written approval.

Saima may identify Customer as a customer only if permitted in an applicable written agreement.

25. Reliance on Information

Information made available through the Services, website, documentation, marketing materials, demos, calculators, case studies, blogs, or other materials is provided for general informational purposes.

Saima does not guarantee that such information is complete, current, accurate, suitable for your specific environment, or sufficient for legal, financial, technical, compliance, or business decisions.

Customer should independently evaluate the Services and consult qualified advisors where appropriate.

Performance metrics, ROI estimates, WER improvements, AHT reductions, CSAT improvements, or other outcomes are illustrative unless expressly guaranteed in a written agreement.

26. Third-Party Content and Links

26.1. Third-Party Content

The Services and/or the Site may display, include, or make available:

  • Third-party content (including data, information, and applications)
  • Products, services, and materials provided by other users and third parties
  • Links to third-party websites, sites, resources, or services
  • Links to third-party applications

(Each, a “Link,” and collectively, including Links, the “Third-Party Materials”)

26.2. No Responsibility

You acknowledge and agree that Saima is not responsible for Third-Party Materials, including their:

  • Accuracy or completeness
  • Timeliness or validity
  • Copyright compliance
  • Legality or decency
  • Quality or fitness for any purpose
  • Security or privacy practices

26.3. Third-Party Opinions

All statements and/or opinions expressed in Third-Party Materials, other than content provided by Saima, are solely the responsibility of the person or entity providing them. Hecttor does not endorse or adopt any Third-Party Materials.

27. Term and Termination

These Terms remain in effect while you use Hecttor.

Saima may suspend or terminate access for:

  • you breach these Terms;
  • payment is overdue;
  • use of the Services creates a security, legal, operational, or reputational risk;
  • required by law;
  • your account is inactive or unauthorized;
  • continued provision of the Services becomes impractical or unlawful.

Upon termination:

  • your right to access and use the Services ends;
  • you must stop using and uninstall the Software where applicable;
  • Customer must delete or return Saima Confidential Information where required;
  • payment obligations remain due;
  • provisions intended to survive will survive.

28. Effect of Termination

The following sections survive termination: license restrictions, prohibited use cases, payment obligations, data rights, intellectual property, confidentiality, feedback, disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and any other provisions that by their nature should survive.

29. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT AS EXPRESSLY STATED IN A WRITTEN AGREEMENT.

SAIMA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ERROR-FREE OPERATION.

SAIMA DOES NOT WARRANT THAT THE SERVICES WILL:

  • MEET CUSTOMER'S SPECIFIC REQUIREMENTS;
  • BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
  • PRODUCE SPECIFIC BUSINESS, TECHNICAL, COMPLIANCE, OR PERFORMANCE RESULTS;
  • PREVENT ALL NOISE, MISCOMMUNICATION, TRANSCRIPTION ERROR, OR OPERATIONAL ISSUE;
  • BE COMPATIBLE WITH EVERY SYSTEM, DEVICE, PLATFORM, OR ENVIRONMENT.

30. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAIMA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS, LOSS OF GOODWILL, LOSS OF DATA, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAIMA'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY CUSTOMER TO SAIMA FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

The limitations above apply regardless of the legal theory, whether contract, tort, negligence, strict liability, statute, or otherwise. Some jurisdictions do not allow certain limitations, so some limitations may not apply.

31. Indemnification

You agree to defend, indemnify and hold harmless Saima, its affiliates, licensors and service providers, and its and their respective officers, directors, shareholders, partners, owners, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable costs and attorneys' fees) arising out of or relating to:

  • your use of the Services;
  • your breach of these Terms;
  • your Customer Application;
  • your violation of applicable law;
  • your failure to provide required notices or obtain required consent;
  • claims by End Users or third parties relating to your use of the Services;
  • your misuse of Saima intellectual property;
  • your third-party integrations or systems.

Saima may assume control of the defense of any matter subject to indemnification, and you agree to cooperate.

32. Export Regulation

The Services may be subject to United States export control and economic sanctions laws and regulations, including the U.S. Export Administration Regulations and regulations administered by the U.S. Department of the Treasury.

You may not use, export, re-export, release, or otherwise make the Services available, directly or indirectly, to any country, jurisdiction, individual, or entity that is prohibited under applicable export control or sanctions laws. You agree to comply with all applicable export and import laws, regulations, and rules, and to obtain any required licenses, approvals, or authorizations prior to exporting, re-exporting, or making the Services available outside the United States.

You represent and warrant that you are not located in, under the control of, or a national or resident of any country or territory subject to U.S. sanctions, and that you are not listed on any U.S. government restricted or denied parties list.

33. U.S. Government Rights

The Services constitute “commercial computer software” and “commercial computer software documentation” as those terms are defined in 48 C.F.R. §2.101.

Accordingly, if you are a U.S. Government agency or contractor, your rights in the Services are limited to those rights customarily provided to the public, as set forth in these Terms, and are provided:

  • Under 48 C.F.R. §227.7201 through §227.7204 for the Department of Defence and its contractors; or
  • Under 48 C.F.R. §12.212 for all other U.S. Government licensees and their contractors.

34. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Unless otherwise agreed in writing, the state and federal courts located in Alameda County or San Francisco County, California will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

Each party consents to personal jurisdiction and venue in those courts.

35. Waiver and Severability

No waiver by Saima of any term or condition outlined in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by Saima to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.

36. Force Majeure

Saima will not be liable for delay or failure to perform due to causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet or telecommunications failures, power outages, cyberattacks, government actions, supply chain disruptions, or failures of third-party platforms.

37. Entire Agreement

These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and Saima, regarding your access to and use of the Services and the Hecttor website, and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral, relating to the same subject matter.

Your access to and use of Hecttor's pages on third-party social media platforms may also be subject to the applicable terms and privacy policies of those platforms.

Any purchase order, order form, or similar document issued by you or Saima is for administrative convenience only. Unless expressly agreed otherwise in a written master services agreement signed by both parties, these Terms shall govern and prevail in the event of any conflict.
